How Kompanion Care collects, uses and protects your personal data as part of the Lilia Moments Application and the WhatsApp Group

At KOMPANION CARE, respecting your privacy and protecting your personal data is our priority.

This privacy policy (the "Privacy Policy") is intended to inform you of how your personal data is processed in connection with your use of the Lilia Moments mobile application (the "Application") and your use of the WhatsApp messaging service in connection with Kompanion Care's services (the "WhatsApp Group"), in accordance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "GDPR") and French Law No. 78-17 of 6 January 1978 on data processing, files and freedoms, as amended (together, the "Applicable Regulations").

1. Who is the data controller?

The data controller is KC KOMPANION CARE, a société par actions simplifiée (simplified joint-stock company), registered with the Paris Trade and Companies Register (RCS) under number 983 608 571, whose registered office is located at 26 rue de Charonne, 75011 Paris, France ("we", "us", "our").

Personal data is data that can be used to identify an individual, either directly or by cross-referencing it with other data.

Retention Your data is retained for the entire duration of your account.

If you delete your account, your data is archived for 1 month, to allow it to be restored in the event of an error or accidental deletion. After this period, it is permanently deleted.

Any account inactive for 2 years will be permanently deleted. A reminder e-mail will be sent to you beforehand; without reactivation on your part, deletion will be carried out automatically at the end of this period.

In addition, your data may be archived for evidentiary purposes for a period of 5 years.
Analyse your use of the services, understand your expectations and improve the features offered (in particular by producing browsing and audience statistics for the Application)

At the end of this period, your data is anonymised. From the point of anonymisation, your data is no longer considered personal data, as re-identification is no longer possible. It is retained for as long as necessary.

Retention If we ask you for proof of identity, we retain it only for the time necessary to verify your identity. Once verification has been carried out, the proof is deleted.

5. Who are the recipients of your data?

The following will have access to your personal data:

  1. Our company's staff;
  2. Our subcontractors: hosting provider, CRM tool, audience measurement and analytics provider, email service provider, transactional email provider, artificial intelligence tools;
  3. Healthcare institutions offering use of the Application to their patients, acting as independent data controllers. We accept no liability for the processing of personal data carried out by our partners and invite you to consult their own privacy notices;
  4. Any authority legally entitled to access it, in particular judicial, police or administrative authorities, upon their request.

6. May your data be transferred outside the European Union?

Your data is retained and stored throughout the duration of processing on the servers of Google Cloud Platform and Xano, located within the European Union.

As part of the tools we use (see the section on recipients regarding our subcontractors), your data may be transferred outside the European Union. Such transfers are secured using the following mechanisms:

8. Changes

We may amend this Privacy Policy at any time, in particular to comply with any regulatory, case-law, editorial or technical developments. Such amendments will apply as of the effective date of the amended version. You are therefore invited to regularly check the latest version of this policy. Nevertheless, we will inform you of any significant change to this privacy policy.
